VENEZUELAN TPS HOLDERS

If you are a Venezuelan national currently in the United States under Temporary Protected Status (TPS), it is critical that you understand the upcoming deadlines and how they affect your immigration options.

⚖️ For Individuals Under the 2021 TPS Designation

If you are under the 2021 Venezuelan TPS designation, which is set to expire soon, you are strongly advised to contact our office immediately and file for asylum by November 7th if you have a genuine fear of persecution in Venezuela.

After November 7th, individuals whose 2021 TPS expires and who have not filed for asylum or obtained another lawful status will begin accruing unlawful presence in the United States. This can seriously impact your ability to adjust your status in the future through family- or employment-based petitions, or to seek asylum.

It is important to note that Venezuelans who have remained in TPS status since their arrival in the U.S., or whose TPS began before their prior lawful status expired, are still eligible to apply for asylum even if more than one year has passed since entry — as long as they have a good faith fear of returning to Venezuela.

⚠️ For Individuals Under the 2023 TPS Designation

The 2023 TPS designation for Venezuela has been terminated following a recent U.S. Supreme Court decision. Individuals covered solely under the 2023 designation will lose their TPS protection and work authorization as that termination takes effect.

If you are under the 2023 TPS designation and have a good faith fear of persecution in Venezuela, you should file for asylum immediately to protect your rights and preserve your ability to remain in the United States lawfully.
